Terms of Service

The terms that govern use of the Wexido platform — accounts, storefronts, orders, bookings, subscriptions, payments, content, and the email and anti-spam rules every store must follow.

Acceptance of these terms

These Terms of Service govern your use of Wexido — the website, the seller dashboard, the storefronts hosted on the platform (including stores served on their own custom domains), and the commerce, communication and email features we provide.

By creating an account, opening a store, buying from a store, or otherwise using Wexido, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service. If you are agreeing on behalf of a company or other organisation, you confirm that you are authorised to bind it, and “you” means that organisation.

Eligibility and accounts

To use Wexido you must be able to enter a binding contract in your jurisdiction, and you must not be barred from using the service under applicable law.

  • Give accurate account information and keep it up to date.
  • Keep your credentials confidential. You are responsible for activity under your account, including activity by people you give access to.
  • Tell us promptly if you believe your account has been accessed without your permission.
  • Do not create an account for someone else without their authority, impersonate another person or business, or open a new account to evade a suspension.

The Wexido platform

Wexido is a multi-tenant commerce platform. Sellers use it to open a storefront, list and sell physical and digital products, take bookings, run subscriptions and memberships, accept orders, manage customers, and send transactional and consent-based marketing messages. Shoppers use it to discover those storefronts and to buy from them.

Wexido provides the platform; it is not the seller. Except where we say otherwise in writing, the contract for a purchase is between the customer and the store. We are not a party to it, we do not take custody of a seller’s goods, and we do not deliver a seller’s services. We do not endorse or guarantee any listing, store, product or service on the platform.

Features differ by plan and may change as the product develops. Some features depend on third-party services (payments, email delivery, domains, storage) and on your compliance with the rules of those services.

Store owner and seller responsibilities

If you run a store on Wexido, you are responsible for it. That means:

  • describing what you sell accurately — price, specification, availability, delivery timeframes, digital file contents, what a booking or subscription includes;
  • fulfilling orders and honouring bookings and subscriptions you accept;
  • publishing and honouring your own store policies, including refunds, returns, cancellations, shipping and privacy;
  • handling customer information lawfully, and only for the purposes the customer would reasonably expect;
  • complying with the law that applies to your business — consumer protection, product safety, licensing, advertising, tax, invoicing and record-keeping;
  • responding to your customers, and to disputes, chargebacks and complaints, in good time; and
  • complying with the email and anti-spam rules below for every message you send through Wexido.

Where you connect a custom domain or use branded sending, you are responsible for the domain and DNS records you control, and for holding the rights to the brand you present.

Customer responsibilities

If you buy on Wexido:

  • provide accurate order, contact, delivery and payment information, and keep your account details current;
  • read the store’s listing and policies before you buy — the store’s terms, refund policy and delivery timeframes apply to your purchase;
  • raise problems with the store first; the store fulfils the order and is the party able to resolve most issues;
  • do not use the platform to defraud a seller, abuse refunds or chargebacks, or harass a store or its staff; and
  • respect the licence you were granted for digital products — see intellectual property below.

Products and services sold on Wexido

Stores can offer several kinds of thing, and the practical terms differ between them.

Physical products

The store is responsible for stock, packing, shipping and any tracking it provides, and for the delivery timeframes it states.

Digital products

Access to purchased files or content is granted after the payment is confirmed. Private files are delivered through short-lived access links. A purchase grants the licence the store describes and nothing more — it does not transfer ownership of the underlying work.

Subscriptions and memberships

A subscription renews on the cycle shown at checkout until it is cancelled. The store sets what a subscription includes and what happens to access when it ends.

Bookings and appointments

Availability, duration, location or joining details, and any reschedule or no-show rules are set by the store. Where a booking requires the customer’s presence or participation, the customer is responsible for attending at the time booked.

Other storefront offerings

Stores may offer events, tickets, services, bundles, auctions or other formats the platform supports. The store’s listing and policies govern them.

Payments

Payments are processed by third-party payment processors. When you pay, you also agree to the processor’s terms for that transaction, and the processor may collect information directly from you. Wexido does not store full card numbers.

Seller payouts, platform and plan fees, processor fees, taxes and currency handling are as described on our pricing page, in your plan, and in the dashboard at the time of the transaction. Where a fee, payout schedule or tax treatment is shown to you in the product, that is what applies.

You are responsible for the taxes that apply to your own sales, and for issuing any invoice or tax document your customers or your jurisdiction require.

Refunds, cancellations and returns

Refunds, returns and cancellations are set by the store you bought from. Each store publishes its own policy, and that policy — together with any rights you have under the law that applies to your purchase — governs whether a refund, exchange, return, cancellation or reschedule is available.

Wexido provides the tools a store uses to issue a refund or cancel an order. We do not decide whether a store’s refund is due, and we do not promise refunds on a store’s behalf. If you and a store cannot agree, contact us and we will help where we can — but the resolution rests between you and the store, and with your payment provider where a chargeback applies.

Fees for Wexido plans and platform services are governed by the plan terms shown at purchase.

Seller content and intellectual property

You keep the rights to the content you upload — listings, descriptions, images, video, files, brand assets and storefront copy. By uploading it, you grant Wexido a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display (for example resizing images), and publicly display and distribute that content, for the purpose of operating, securing and promoting the service and your storefront. The licence lasts as long as we host the content, and ends within a reasonable period after you remove it, except for copies retained in backups or required by law.

You confirm that:

  • you own or are licensed to use everything you upload, including any third-party material, fonts, music, imagery and trademarks; and
  • your content does not infringe anyone’s rights and does not breach any law.

If you believe content on Wexido infringes your rights, contact us with enough detail to identify the material and your claim, and we will review it. We may remove content and suspend accounts for repeat infringement.

Prohibited products, content and activity

You must not use Wexido to list, sell, promote or carry out anything that is:

  • illegal under any law that applies to you, your store or your customers, or that requires a licence or authorisation you do not hold;
  • fraudulent, deceptive or misleading — including fake listings, fake reviews, misrepresented goods, deceptive pricing, and money laundering or other financial crime;
  • infringing — counterfeit goods, pirated media, or anything that breaches copyright, trademark or other rights;
  • harmful or dangerous — weapons, controlled substances, hazardous materials, or products restricted or recalled where they are sold;
  • abusive or exploitative — harassment, threats, hate speech, content that sexualises or endangers minors, or non-consensual intimate material;
  • invasive of privacy — selling or exposing other people’s personal data, credentials or account access; or
  • technically abusive — malware, phishing, scraping the platform, probing or circumventing our security or rate limits, or interfering with the service or other users.

This is not an exhaustive list. We may refuse, remove or restrict any listing, store, content or account we reasonably believe breaches these terms or exposes users, the platform or our providers to legal or security risk.

Email and anti-spam policy

Wexido’s email infrastructure is shared. One store sending unwanted mail damages deliverability for every other store on the platform, so these rules are strict and we enforce them.

You must not, whether through Wexido’s email features, a Wexido-hosted storefront, or branded sending you configure through Wexido:

  • send unsolicited bulk email, or anything that would reasonably be considered spam;
  • use purchased email lists;
  • use rented, leased, borrowed, co-registration or otherwise third-party-sourced lists;
  • use scraped, harvested, guessed or appended email addresses, from any source;
  • send marketing to recipients who have not given appropriate consent to hear from you;
  • import a contact list you cannot show consent for;
  • mislead recipients about who is sending — including forged or deceptive sender names, addresses, reply-to values, headers or subject lines;
  • omit, hide, break or otherwise circumvent the unsubscribe mechanism, or make unsubscribing conditional on anything (a reply, a sign-in, a fee, a form);
  • repeatedly send to addresses that have hard-bounced;
  • continue marketing to a recipient who has unsubscribed;
  • continue marketing to a recipient after an applicable spam complaint;
  • re-add, re-import or resubscribe an address that unsubscribed, complained or was suppressed, without a fresh and valid opt-in from that person;
  • disguise marketing as a transactional or service message in order to reach people who have opted out; or
  • otherwise abuse Wexido’s email infrastructure, or use it to send on behalf of an unrelated third party.

Transactional and service messages — verification, password reset, order, payment, booking, subscription and security notifications — must be genuinely triggered by the recipient’s own account, order or request, and must not carry promotional content that turns them into marketing.

Email consent requirements

If you send marketing through Wexido, you are responsible for obtaining and being able to demonstrate legally valid consent from every recipient, under the law that applies to that recipient. Contacts may enter the marketing system only through Wexido or storefront consent flows.

We may require, at our discretion, that you:

  • collect an explicit opt-in for marketing, separate from a purchase or an account sign-up;
  • use double opt-in, which is enabled by default, so the recipient confirms their own address;
  • keep consent records — opt-in source, timestamp, IP address, user agent and current consent status;
  • produce proof of consent for a list, a segment or an individual recipient on request;
  • identify yourself accurately as the sender, with a valid postal or contact address where the law requires it; and
  • stop sending to a list, or delete it, where consent cannot be shown.

Consent is specific to you as the sender. A recipient who consented to hear from one store has not consented to hear from another, and consent does not transfer with a list, an acquisition or a store transfer unless the recipient agreed to that.

Email reputation and enforcement

We monitor how mail sent through the platform performs, and we act to protect recipients, other stores and the platform’s sending reputation. We may:

  • monitor bounce rates, complaint rates, unsubscribe rates and other delivery and engagement signals, per store and per campaign;
  • require you to verify a sending domain or address before you send;
  • suppress individual recipients from your sending;
  • throttle, delay or cap sending volume;
  • hold, review or refuse a campaign before it goes out;
  • require evidence of consent, or list cleaning, before sending resumes;
  • suspend marketing email for a store while leaving transactional messages running;
  • suspend a store’s sending or the store itself; and
  • suspend or terminate access for serious or repeated abuse.

We will normally tell you what happened and what is needed to restore sending, and we will normally act proportionately and with notice — but where recipients, the platform or our providers are at immediate risk we may act first and notify afterwards.

We do not publish fixed numeric thresholds. Bounce, complaint and unsubscribe rates are assessed in context — volume, list source, history and the standards our email provider and receiving mail providers apply.

Hard bounce behaviour

A hard bounce means a receiving mail provider has told us the address is permanently undeliverable — it does not exist, or it will not accept mail. Continuing to send to such an address signals to mail providers that the sender does not maintain its lists, and it harms deliverability for every sender on the platform.

Hard-bounced addresses are therefore suppressed from future sending. Suppression applies automatically and persists; the address stays suppressed until there is a legitimate reason to believe it is valid again, and the suppression record itself is retained so the mail does not simply resume. Removing or bypassing a suppression to keep sending to a hard-bounced address is a breach of these terms.

Complaint and unsubscribe behaviour

When a recipient unsubscribes — through the link in a message, through the one-click unsubscribe their mail client offers (RFC 8058), or through their preferences — we stop applicable marketing to that recipient. When a recipient marks a message as spam, or a mail provider passes us a complaint, we do the same.

Unsubscribes and complaints are enforced by the platform, not left to the sender to apply. They do not, by themselves, stop transactional and service messages that the recipient’s own account, order, booking or subscription requires.

You must not re-add, re-import or otherwise resubscribe someone who unsubscribed or complained without a fresh, valid opt-in from that person.

User-generated content

Wexido carries content created by users: listings, storefront copy, posts, reviews, ratings, messages, profiles and uploaded media. You are responsible for what you post, and you must not post anything unlawful, infringing, deceptive, abusive or otherwise prohibited under these terms.

Reviews and ratings must reflect genuine experience. Do not post or solicit fake reviews, incentivise reviews in a way that distorts them, or review your own store.

We do not pre-screen user content and are not responsible for it. We may remove or restrict content, and suspend accounts, where content breaches these terms or the law — and we may do so without prior notice where the content is seriously harmful.

Platform availability and changes

We work to keep Wexido available and performing well, but the service is provided on an as-available basis. Maintenance, deployments, third-party outages, network problems and factors outside our control can interrupt it. Where we plan significant maintenance, we will give notice where practical.

We may add, change, deprecate or remove features, and change plan contents and limits. Where a change materially reduces a paid feature you rely on, we will give reasonable notice where practical.

Security and abuse

You must not:

  • probe, scan or test the vulnerability of the platform, or breach or circumvent its security or authentication;
  • access accounts, data, stores or systems you are not authorised to access;
  • scrape, crawl or bulk-extract data from the platform except as our robots rules allow;
  • interfere with the service — denial of service, flooding, abusing rate limits, or overloading our infrastructure or our providers;
  • upload malware, or use the platform to distribute it or to host phishing content; or
  • bypass usage limits, quotas, plan restrictions or suppression and unsubscribe controls.

If you find a security vulnerability, please report it to us privately at support@wexido.com rather than exploiting or publishing it, and give us reasonable time to fix it.

Suspension and termination

You can stop using Wexido at any time, close your store, or ask us to close your account. Obligations already incurred — open orders, active bookings and subscriptions, amounts owed, and record-keeping duties — survive.

We may suspend or terminate an account, a store, or access to a feature where we reasonably believe:

  • these terms or our policies have been breached;
  • the activity is unlawful, fraudulent or exposes users or the platform to legal, financial or security risk;
  • email or sending abuse is occurring, per the sections above;
  • a payment due to us has failed or is overdue; or
  • we are required to act by law or by one of our providers.

We will normally give notice and, where the breach can be fixed, an opportunity to fix it. Where the risk is serious or immediate, we may suspend first and explain afterwards. On termination your right to use the service ends, published storefronts may be taken offline, and we may delete or retain data as described in the Privacy Policy.

Wexido’s intellectual property

Wexido — the platform, its software, design system, templates, documentation, name, logo and brand assets — belongs to us or our licensors and is protected by intellectual property law. These terms grant you a limited, revocable, non-exclusive, non-transferable right to use the service as it is intended to be used, for as long as your account is in good standing.

You must not:

  • copy, modify, reverse engineer, decompile or create derivative works from the platform, except where the law expressly permits it;
  • resell, sublicense or white-label the platform except as a feature we explicitly provide; or
  • use our name, logo or brand in a way that suggests endorsement or partnership without our written permission.

Feedback you send us is welcome, and we may use it to improve the product without obligation to you.

Third-party services

Wexido relies on third-party services — cloud infrastructure, email delivery (including Amazon Simple Email Service), payment processors, storage and CDN providers, analytics, domain and DNS providers, and anti-abuse services. Stores may also connect integrations of their own.

Those services are operated by their providers under their own terms and policies, and using them may mean their terms apply to you as well. We are not responsible for a third-party service’s availability, acts, omissions or content, and we do not control changes those providers make. Naming a provider is not an endorsement of Wexido by that provider, and does not mean any provider has approved, certified or reviewed Wexido or your use of it.

Disclaimers

The service is provided “as is” and “as available”. To the extent permitted by law, and without excluding anything that cannot lawfully be excluded, we do not warrant that the service will be uninterrupted, error-free, or fit for a particular purpose, and we do not guarantee any commercial result — sales, traffic, deliverability, inbox placement or search visibility.

Wexido is a platform, not the seller and not a party to a customer’s purchase from a store. We do not verify, endorse or guarantee any store, listing, product, service, review or user, and we are not responsible for a store’s fulfilment, quality, legality or conduct, nor for the accuracy of content users publish.

Nothing here limits rights you have under consumer protection law that cannot be excluded or limited by agreement.

Limitation of liability

To the extent permitted by law, Wexido and its officers, employees and suppliers are not liable for indirect, incidental, special, consequential, exemplary or punitive loss, or for lost profits, lost revenue, lost sales, lost goodwill, lost data, or business interruption, arising out of or relating to your use of the service — even if we were told such loss was possible.

To the extent permitted by law, our total aggregate liability arising out of or relating to the service is limited to the amounts you paid us for the service in the period immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations. Where that is the case, these limits apply only so far as the law permits, and nothing in this section excludes liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded.

Indemnity

You agree to indemnify and hold harmless Wexido and its officers, employees and suppliers from claims, demands, losses, liabilities and reasonable costs (including legal fees) arising out of or relating to:

  • your content, listings, products, services or storefront;
  • your sales, fulfilment, refunds and dealings with your customers;
  • email you send through the platform, including any consent, spam or data-protection claim relating to it;
  • your breach of these terms or of any applicable law; and
  • your infringement of anyone else’s rights.

We will notify you of a claim we intend to seek indemnity for, and you may not settle a claim in a way that imposes an obligation on us without our consent.

Governing law and disputes

Changes to these terms

We may update these terms as the product, our providers or the law change. When we do, we will change the “Last updated” date at the top of this page. Where a change materially affects your rights or obligations, we will give notice in the product or by email before it takes effect, where that is appropriate.

Continuing to use Wexido after an update takes effect means you accept the updated terms. If you do not accept them, stop using the service and close your account.

General

These terms, together with the Privacy Policy and any plan or feature terms shown to you in the product, are the whole agreement between you and us about the service.

  • If any provision is found unenforceable, the rest remains in force.
  • Not enforcing a provision immediately does not waive it.
  • You may not assign these terms without our consent; we may assign them as part of a merger, acquisition or sale of assets.
  • There is no partnership, agency, employment or joint venture between us.
  • Section headings are for convenience and do not affect interpretation.
